Terms of Service
I. General

NexStep Internet offers its customer unrestricted Internet access and services. These services include web hosting, custom design services and consultation. NexStep Internet has no control over content offered on the worldwide web.
We also have no control over the quality or accuracy of information you may find. It is recommended that you properly supervise minor children who have access to the internet. These terms of service provide the general guidelines for NexStep's services and usage. NexStep may change these terms of service on-line at any time. By agreeing to NexStep's services, the customer is legally bound by these terms of service. If a new terms of service is released, the subscriber is contractually bound to the new terms, until the policy is over, or is terminated. We ask our customers to check the terms of service regularly for changes. Any non-compliance with these terms of service will result in action taken by NexStep as deemed appropriate by NexStep. If any of NexStep's policies or services become unacceptable by the customer, termination of the account with no refunds is the only course of action. NexStep holds the right to terminate any customer's account with five days notice.

II. Lawful Use
All customers must be at least 18 years old to register for any of NexStep's Internet Service. NexStep's services may only be used for lawful purposes.
Content on all NexStep hosted web sites must comply with federal and state laws. NexStep's services shall not be used in a manner which would violate any laws including: infringement of any copyright, trademark, trade secret; infringement of the right of privacy, or any other right of any person; or for the purpose of storing material which is obscene or derogatory. Use and access to other networks through NexStep 's services must comply with the rules for such other networks. Spamming (the sending of unsolicited mass e-mails) is not allowed under these terms of service and will subject the subscriber's account to termination. Posting inappropriate items in chatrooms by the customer is not allowed under these terms of service and will subject the account to termination.

III. Changes to Service
NexStep's services will change from time to time. NexStep holds the right to change any service offered without notice.

IV. Payment Terms
The customer must pay the fees incurred with each service on the day of activation and monthly thereafter. Fee changes will be effective when published, or when they are provided to customers. Activation fees are not refundable. Late fees are subject to a 10 day grace period, after which the account will be subject to termination. If the customer wishes to terminate an account, the customer is accountable for the entire month. If no payment is received, the customer agrees to pay any fees demanded by NexStep. Any checks or transactions that are returned for non-sufficient funds will be charged a $25.00 fee.

V. Termination and Suspension
Either the customer or NexStep may terminate the customer's account at any time for any reason. It is the customer's responsibility to contact NexStep if the customer wishes to terminate their contract. Failure to do so may result in additional charges to the customer. If the customer would like to move their website and domain name, and wishes Nexstep to transfer the domain name and website there will be a $137.00 charge. If a customer wishes to move their website and domain name on their own, there will be no charge. NexStep also may at any time suspend a customer's account for any reason NexStep deems appropriate. Monthly charges are not prorated. Termination or suspension of a customer's account does not relieve the customer of any charges due. Upon account termination, NexStep may delete all data, files or any other information that was stored in the customer's account. If for any reason you wish to move your domain name from us, your account must be paid in full in order for us to release your domain name from our account.

VII. Warranty; Limitation of Liability
NexStep's services are provided on an "as is" and "as available" basis with no warranty of any kind. Under no circumstances is NexStep to be held responsible for any indirect, incidental, special or consequential damages that may occur.

VIII. Indemnity
The customer agrees to indemnify and hold harmless NexStep, its directors, officers, shareholders, agents, employees and its other subscribers from any and all claims, liabilities, damages or expenses (including attorney fees) arising out of or resulting from any and all use of the subscriber's account or the subscriber's Web Site, whether authorized by NexStep or the subscriber or not.

IX. Transferability
The customer's account cannot be transferred without NexStep's approval. The customer agrees to keep their username and password confidential, as to keep our accounts secure and private.
